
On Monday, August 18, attorneys for Baldoni, 41, submitted a court filing rejecting Ferrer's claims, stating that her "opposition is primarily an inappropriate attack upon Mr. Baldoni and his counsel relating to matters not before the Court and irrelevant" to whether she should be served a subpoena.
Baldoni first issued a subpoena to Ferrer in July. His lawyers later filed a motion on August 12 alleging that Ferrer, 24, had been unresponsive and unreachable. In response, Ferrer's legal team argued that Baldoni had engaged in "bad faith tactics," insisting his motion was made "for improper purposes and with the aim of harassing" her. They asked the court to deny his request and to impose sanctions. Ferrer played the younger version of Lively's character in the 2024 film It Ends With Us.
In their latest filing, Baldoni's attorneys explained that Ferrer was subpoenaed for documents she either failed to provide or that were not included in a subpoena issued to her earlier this year by Lively's lawyers. Lively, 37, has filed a lawsuit against Baldoni and his production company Wayfarer Studios, alleging sexual harassment and retaliation, accusations that Baldoni and his team strongly deny.
Baldoni also rejected the suggestion that serving Ferrer with a subpoena amounted to harassment. His attorneys argued that Ferrer and her legal team had obstructed efforts to obtain discovery that was critical to his defense, while Lively was allowed access to her materials.
To resolve the dispute, Baldoni's lawyers suggested the court consider barring both parties from using Ferrer's communications or testimony in the case, which they said would accommodate her desire to avoid involvement in the trial. They also noted that Ferrer had previously thanked Baldoni, describing her experience working with him as "incredible" and praising the "comfortable, safe space" he created during filming.
Ferrer's legal team countered that her positive text messages to Baldoni reflected typical remarks from a young actress working with a director on her first feature film.
Court documents indicate that Lively's attorneys had previously stated that two female co stars from It Ends With Us agreed to testify about their experiences with Baldoni, although they were not identified.
The trial is set to begin in March 2026.
