In court documents acquired by E! News on August 21, Samantha Cope, the wife of the Blossom star, filed for divorce, citing "irreconcilable difference" as the cause for the breakup. The couple had been married for two years.
Samantha requested the termination of each spouse's claim to spousal support and named June 7 as the date of the couple's separation.
She also wants joint legal and complete physical custody of their 19-month-old daughter Dylan.
"Samantha will have 100% physical custody of Dylan with visitation to Joe at Samantha's discretion," the suit stated. "Once Dylan is 3 or older, Joe will have the option to take her for 2 nights in her home location if he is not working and can facilitate her visiting."
The actress from Insecure, who wed Joey in May 2022 in a California wedding, also said in her parenting plan that Joey will not be allowed to take his baby for "long, extended periods of time until she is old enough to specifically ask for the visitation time and all parties agree and are able to facilitate."
"He must be available for the full time she is visiting while she is a minor," the paperwork said, adding that Dylan "is not to be in the presence of any non-family members while with Joe unless agreed upon by Samantha."
Joey, who was previously married to Michelle Vella and Chadie Yawn-Nelson and has daughters Charleston, 18, and Liberty, 14, with them, is divorcing for the third time.
While filming their 2021 Lifetime drama My Husband's Secret Brother, in which he played Samantha's lover-turned-murderer, the actor got to know Samantha for the first time.
In a December People interview, Joey recalled the meet-cute by saying, "I'd never dated somebody that I'd worked with before." "That was just very, very much out of the ordinary for me."
He continued, "Look, life is a beautiful, sometimes crazy-unexpected journey, and the ups and downs are real, and I'm very thankful that people that I love are around me and that there's health around us."
